Legal and Compliance Management

Acting in the legal, compliance and corporate governance areas, acting as a partner of member companies, in legal advice and strategy whenever necessary, aiming at better alternatives and solutions for the improvement of the medical devices sector.

It develops its activities through:

  • Elaboration of opinions, research and technical works, following changes in the national legal system, with the aim of identifying and pointing out situations of interest to the sector.
  • Legal support to the executive and senior management of ABIMED.
  • Management of external legal offices
  • Proposal and follow-up of legal measures for the defense of the sector and its members.
  • Acting in committees and working groups to identify legislative and/or judicial issues that affect the sector, especially in the tax, environmental, regulatory areas, among others.
  • Legal administration of the association’s corporate routine – control of contracts, service providers, issuance of documents and other components of the entity’s corporate legal system.

CODE OF CONDUCT

ABIMED advocates and promotes an ethical business environment, with transparent and constructive relationships, aiming to provide the Brazilian population with access to innovative health technologies.

With this in mind, since 2006, ABIMED has developed and has been improving its Code of Conduct, with its last review completed and presented in December 2021. All its members are signatories committed to complying with its provisions upon subscription. This obligation extends to due diligence processes at its distributors.

This publication is a document with educational content regarding the conduct of ABIMED members. It is available on this website without restrictions and has no commercial value. Its distribution is free of charge.

ABIMED was the very first association in the medical device sector in the Healthcare industry to establish a Code of Conduct. It is also the only in the sector to establish an Independent Ethics Committee, whose mission is to prepare and propose changes to the Code of Conduct. When members fail to observe the precepts of the Code of Conduct, ABIMED acts, investigating, pondering and enforcing applicable administrative proceedings in case of violations.

In addition, as part of its Strategic Pilar of Governance and Transparency, ABIMED carries out various educational initiatives, seeking to reinforce the concepts of good practices, transparency, ethics and governance with its members.

The training program in EAD format on the 6th version of our Code of Conduct of our “Compliance and Code of Conduct” manual was successfully concluded on September 30th. It was made available to our members, their distributors and selected third parties. The training was offered through a digital platform, especially developed for this project. We recorded over 3,000 training sessions, offered to 94 members via digital platform. More than 1,000 certificates of participation were issued since. The participation of more than 90 members goes to show companies are eager to adopt and follow the utmost modern criterion in terms of governance and compliance defined by ABIMED.
