Diálogos ABIMED: ten years of the anti-corruption law

Ethics was the center of the debate promoted by ABIMED on May 24 at the Hospitalar 2023 Fair, which analyzed the ten years of the anti-corruption law – Law 12.846/2013 – and its impacts on the segment of medical equipment and devices.
Participating in the panel were Eduardo Winston, president of the Board of Directors of the Ethics Health Institute; Marcelo Zenkner, partner of the Compliance and Investigation, Administrative Law and Governmental Projects, and ESG areas of Tozzini Freire Advogados; and Gustavo Biagioli, member of the Independent Ethics Commission of ABIMED.
For Zenkner, the most important thing is not to penalize what is wrong, but to value benign actions. “The regulation of the law brought us an insertion of the fostering of the culture of integrity. The law is not against corporate corruption, but rather, a law of legal integrity,” he said.
Winston emphasized that there is a need for a mechanism that transforms this law into a culture and shapes behaviors. “Often, executives want Compliance programs not because they are against harmful practices, but to know how to better deal with their consequences, or even to effectively hide them,” he added.
“Compliance with the law, in itself, is not ethical, it is an obligation,” argued Biagioli, warning that companies shall make available efficient channels for denunciations.
